Lukáš Novopacký specialises primarily in
insolvency law, restructuring, and representation of clients in
litigation and arbitration matters.
In insolvency and restructuring, he has
an extensive experience in comprehensive representation of creditors and
debtors in insolvency proceedings, as well as representation of
insolvency trustees in complex incidence disputes. As part of insolvency
proceedings Lukáš deals mainly with security and its enforcement in
individual insolvencies, ineffectiveness of legal acts, and protection
from vexatious insolvency petitions. In addition to insolvency
proceedings, he also specialises in enforcement of claims for
compensation for damage caused to creditors due to late submission of,
or failure to submit, an insolvency petition, as well as enforcement of
claims for compensation for damage caused due to breaching various
obligations in insolvency proceedings He also gives lectures on
insolvency law, including the topic on debt discharge.
In litigation, Lukáš represents clients, as plaintiffs or defendants, from pre-trial stage of disputes to enforcement of successfully obtained enforcement title. During his practice he has gained extensive experience in various types of disputes arising from complex construction contracts, disputes on invalidity of legal acts, disputes involving notes, as well as common commercial disputes.
Prior to joining our law firm, he worked for more than three years with a renowned insolvency trustee with special permission, where he gained experience in insolvency law while advising in major insolvency proceedings in the Czech Republic. He also worked as a legal trainee for several months at a minor law firm specialising in criminal law.
