Team

We provide legal services in all aspects areas of real estate and construction projects with a significant share of the real estate legal advisory services market in the Czech Republic and Slovakia. Our real estate and construction team consists of more than 30 lawyers, is led by the managing partner Jaroslav Havel with support of another 6 partners, and according to available information represents one of the largest legal team focusing on real estate and construction in the Czech Republic and Slovakia.

Our comprehensive legal and tax services in the fields of real estate and construction include the following:

Real estate and construction law

  • advising on real estate sales and acquisitions (including legal due diligence, the preparation/review and negotiation of transaction documentation, and transaction structuring proposals including tax structuring)
  • advising in connection with the development of residential projects including the subsequent sale of individual residential units
  • advising on greenfield and brownfield projects including turnkey projects
  • advising on the development and regeneration of industrial real estate (brownfield investments), including a review of ownership relationships, legal aspects of construction, renovation and environmental issues
  • advising on facility management (such as lease agreements and dealing with lessees)
  • representation in administrative proceedings relating to zoning and development, including administrative penalties and administrative justice
  • advising on project financing, structuring and negotiations for agreements with financial institutions
  • seminars and tailored training aimed at the most significant changes in private law related to real estate
  • client representation in judicial proceedings and arbitrations
  • active involvement in professional, real estate related organisations in the Czech Republic, such as the Association for Real Estate Market Development, the Czech Construction Law Society and the Association for Foreign Investments with the government agency CzechInvest

Environment

  • advising on the assessment of compliance with environmental laws
  • advising on the solution of environmental pollution
  • representation in disputes relating to the environment and public participation; the elimination of vexatious practices
  • representation in environmental permit procedures, including representation in administrative and judicial proceedings
  • advising on liability for environmental damage
  • advising on regulations governing individual components of environmental law, particularly waste disposal, water management, water and sewer system regulations, mining law and air protection including emissions trading

Public sector

  • client representation in connection with tenders issued by the state or self-governments (including procedures under the rules of international organisations, such as the European Investment Bank)
  • advising in connection with PPP projects, including incorporation of public entities and legal services related to companies, construction firms, manufacturers, consultancies and service providers
  • advising on investment incentives and state aid for greenfield and brownfield projects
